By accessing or using this website, you agree to these Terms. If you do not agree, please do not use this website or engage our services. Your use of this website is also subject to our Privacy Policy, which is incorporated into these Terms by reference.
Note: Specific client engagements are governed by a separate Client Services Agreement provided at the time of engagement. If there is a conflict between these Terms and a Client Services Agreement, the Client Services Agreement controls.
1. Services
1.1 Description. Funnel Amp, LLC provides AI Knowledge Base Architecture and RAG (Retrieval-Augmented Generation) Documentation services for B2B organizations, through three engagement types:
- Knowledge Base Audit — An assessment of your existing source documents and knowledge base, identifying retrieval gaps and structural weaknesses, with a written findings summary and recommended action plan.
- RAG Documentation Build — A full-engagement service to design and build your RAG documentation architecture, including source document inventory, semantic chunking, metadata tagging, and delivery of a machine-readable knowledge base with handoff documentation.
- Knowledge Base Refresh — Project-based updates to a knowledge base previously built by Funnel Amp, including new source document integration, metadata and taxonomy updates, retrieval accuracy re-testing, and updated delivery documentation.
1.2 Website Information. Service descriptions, pricing, and timelines on this website are for general informational purposes only and are subject to change without notice. Nothing on this website is a binding offer or guarantee of availability.
1.3 Right to Refuse Service. Funnel Amp reserves the right to decline service to any person or organization, at any time, for any reason.
1.4 No Consumer Use. Funnel Amp’s services are for business-to-business engagements only and are not offered to individual consumers.
1.5 Feedback. If you share feedback about this website or our services, you grant Funnel Amp a perpetual, irrevocable, royalty-free license to use that feedback for any business purpose. You retain ownership of any intellectual property rights in your feedback.
2. Intellectual Property
2.1 Funnel Amp Content. All content on this website — including text, graphics, logos, service descriptions, methodologies, and design — is owned by Funnel Amp, LLC or its licensors and protected by applicable intellectual property laws. Nothing here grants you a license to use Funnel Amp’s intellectual property without prior written consent.
2.2 No Implied Licenses. These Terms do not grant you any rights to Funnel Amp’s intellectual property, content, brand, or proprietary information.
2.3 Portfolio Use. Funnel Amp may reference your organization’s name in a client list. We will not publish or describe project-specific details without your prior written consent.
3. Website Use and Conduct
3.1 Prohibited Uses. You may not use this website or Funnel Amp’s services to: (a) violate any applicable law or regulation; (b) infringe any intellectual property rights; (c) transmit viruses, malware, or disruptive code; (d) collect personal information of others without authorization; (e) submit false or misleading information; (f) interfere with or circumvent website security; or (g) harass, defame, or discriminate against any person or group. Violations may result in immediate termination of your access.
3.2 Accuracy of Submissions. You represent that any information you submit through this website is accurate and complete. Funnel Amp is not responsible for errors or outcomes arising from inaccurate information you provide.
4. Third-Party Tools and Links
4.1 Third-Party Tools. This website and certain engagements may involve third-party tools or platforms (such as payment processors). Funnel Amp is not responsible for the performance, availability, or data practices of any third-party tool and provides access to such tools “as is” without warranty or endorsement.
4.2 Third-Party Links. Links to third-party websites are provided for convenience only. Funnel Amp does not endorse them and is not responsible for their content, accuracy, or privacy practices. Your interactions with those sites are solely between you and that third party.
5. Term and Termination
5.1 Term. These Terms take effect when you first access this website and remain in effect as long as you continue to use it.
5.2 Termination by You. You may stop using this website at any time, which constitutes your termination of these Terms.
5.3 Termination by Funnel Amp. Funnel Amp may suspend or terminate your access at any time, with or without notice, including for violation of Section 3.1 or any applicable law.
5.4 Survival. Sections 2 (Intellectual Property), 6 (Warranties and Limitations), 7 (Indemnification), 8 (Disputes), 9 (Miscellaneous), 10 (Copyright, Minors, and Compliance), and 11 (Data Handling and Security) survive termination or expiration of these Terms.
6. Warranties and Limitations
6.1 Mutual Representations. Each party represents that it has full legal authority to enter into these Terms and that doing so does not violate any applicable law or existing agreement.
6.2 Disclaimer of Warranties.
EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS, THIS WEBSITE AND ALL CONTENT AND SERVICES ACCESSIBLE THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. FUNNEL AMP EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY IMPLIED WARRANTY ARISING FROM COURSE OF DEALING OR PERFORMANCE. FUNNEL AMP DOES NOT WARRANT THAT THIS WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. FUNNEL AMP DOES NOT WARRANT THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT ON THIS WEBSITE.
6.3 Limitation of Liability.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (A) IN NO EVENT WILL FUNNEL AMP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, OR LOSS OF BUSINESS OPPORTUNITY — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THIS WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY OF LIABILITY; AND (B) FUNNEL AMP’S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THIS WEBSITE SHALL NOT EXCEED THE GREATER OF: (I) THE TOTAL FEES ACTUALLY PAID BY YOU TO FUNNEL AMP IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (II) ONE HUNDRED U.S. DOLLARS ($100). FOR WEBSITE VISITORS OR PROSPECTIVE CLIENTS WHO HAVE NOT PAID ANY FEES, THE CAP SHALL BE $100. THE PARTIES ACKNOWLEDGE THAT THESE LIMITATIONS REFLECT A REASONABLE ALLOCATION OF RISK AND FORM AN ESSENTIAL BASIS OF THE AGREEMENT BETWEEN THEM.
7. Indemnification
7.1 Indemnification by You. You agree to defend, indemnify, and hold harmless Funnel Amp, LLC, its principal, successors, and assigns from any third-party claim — including reasonable attorneys’ fees — arising from: (a) your breach of these Terms; (b) your use or misuse of this website; (c) your violation of any applicable law; or (d) any content or information you submit through this website.
7.2 Exclusions. Your indemnification obligations do not apply to claims arising from Funnel Amp’s own fraud, willful misconduct, or material breach of these Terms.
7.3 Process. Funnel Amp will notify you promptly of any claim for which indemnification is sought and will cooperate reasonably in the defense. You will have reasonable control over the defense and settlement, except that no settlement may require Funnel Amp to admit wrongdoing or incur ongoing obligations without Funnel Amp’s prior written consent.
8. Disputes
8.1 Informal Resolution. Before initiating arbitration, the party raising a dispute must notify the other in writing. The parties will attempt in good faith to resolve the matter informally. If unresolved after 45 days, either party may proceed to arbitration.
8.2 Arbitration. Unresolved disputes will be submitted to final, binding arbitration under the then-current Commercial Arbitration Rules of the American Arbitration Association (“AAA”), before a single arbitrator. The seat of arbitration is Cuyahoga County, Ohio. Hearings may be conducted remotely or at a mutually agreed location. The arbitrator may not award punitive damages or modify these Terms. Judgment on the award may be entered in any court of competent jurisdiction.
EACH PARTY WAIVES ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION IN CONNECTION WITH THESE TERMS, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
8.3 Equitable Relief. Nothing in this Section 8 prevents either party from seeking injunctive or other equitable relief in court for matters involving intellectual property or where monetary damages would be inadequate.
9. Miscellaneous
9.1 Force Majeure. Neither party will be liable for delays or failures in performance caused by circumstances beyond its reasonable control, including natural disasters, internet or infrastructure outages, pandemics, or acts of government.
9.2 Assignment. You may not assign your rights or obligations under these Terms without Funnel Amp’s prior written consent. Funnel Amp may assign freely. These Terms bind and benefit each party’s permitted successors and assigns.
9.3 Notices. Legally required notices must be in writing, delivered by email or postal mail, and are effective upon confirmed receipt.

9.4 Electronic Communications. By using this website or submitting a contact form, you agree to receive electronic communications from Funnel Amp related to your inquiry or engagement. Marketing communications require a separate opt-in and may be unsubscribed at any time.
9.5 Amendment. Funnel Amp may update these Terms at any time by posting a revised version to this website. Updates take effect 30 days after posting. Continued use of this website after that date constitutes acceptance of the revised Terms.
9.6 Interpretation. These Terms will be interpreted without favor to either party as the drafter. Section headings are for convenience only. The word “including” is not limiting.
9.7 Governing Law; Venue. These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. For any claim subject to the equitable relief carve-out in Section 8.3, or any matter not subject to arbitration, each party consents to the exclusive jurisdiction of the state and federal courts located in Cuyahoga County, Ohio, and waives any objection to such venue.
9.8 Severability. If any provision of these Terms is found invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable. All remaining provisions continue in full force.
9.9 Entire Agreement. These Terms, together with any applicable Client Services Agreement and our Privacy Policy, constitute the entire agreement between you and Funnel Amp regarding use of this website. No other statement or communication creates binding obligations unless signed by both parties.
9.10 Waiver. Failure to enforce any provision of these Terms does not waive that right or limit enforcement in the future.
10. Copyright, Minors, and Compliance
10.1 DMCA — Copyright Infringement Claims. Funnel Amp respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on this website infringes your copyright, send a written notice to our designated agent including: (a) your signature or that of an authorized representative; (b) identification of the copyrighted work; (c) identification of the infringing material and its location on this website; (d) your contact information; (e) a statement of good-faith belief that the use is not authorized; and (f) a statement under penalty of perjury that the notice is accurate and that you are the copyright owner or authorized agent.

Funnel Amp reserves the right to remove allegedly infringing content and to terminate access for repeat infringers.
10.2 Children’s Privacy (COPPA). This website is intended for business professionals only. Funnel Amp does not knowingly collect personal information from children under 13. If you believe a child has submitted information through this website, please contact us at hello+po******@*******mp.com and we will promptly delete it.
11. Data Handling and Security
11.1 Scope of Client Data. During service engagements, clients may submit proprietary business documents — such as internal policies, standard operating procedures, and organizational source materials (collectively, “Client Data”). Funnel Amp does not require personal data about individual consumers or employees as part of its standard engagement process. Clients are responsible for ensuring submitted data does not include personal data beyond what is necessary for the engagement.
11.2 Purpose Limitation. Funnel Amp uses Client Data solely to deliver the agreed services. Client Data will not be used for model training, product development, or marketing without your prior written consent.
11.3 Security Measures. Funnel Amp maintains commercially reasonable administrative, technical, and physical safeguards to protect Client Data against unauthorized access, disclosure, alteration, or destruction. All work is performed internally; Client Data is not shared with third-party subcontractors or external platforms.
11.4 Retention and Deletion. Funnel Amp retains Client Data for twelve (12) months after project completion or termination, after which it is securely deleted. Clients may request earlier deletion by contacting hello+po******@*******mp.com in writing. Funnel Amp will confirm deletion within 30 days of a valid request.
11.5 Data Breach Notification. If Funnel Amp confirms a security breach resulting in unauthorized access to Client Data, it will notify the affected client in writing within 30 days of confirmation, unless applicable law requires earlier notice. The notification will describe the nature of the breach, the categories of data affected, and the remediation steps taken.
11.6 GDPR and CCPA. Funnel Amp acknowledges that certain clients may be subject to the EU General Data Protection Regulation (“GDPR”) or the California Consumer Privacy Act (“CCPA”). To the extent Client Data contains personal data subject to either regulation, Funnel Amp will process it only as directed by the client and solely for service delivery purposes. Clients requiring a Data Processing Agreement (“DPA”) under GDPR Article 28 may request one at hello+po******@*******mp.com. Website visitor data practices are described in our Privacy Policy.
11.7 Client Representations. You represent that you have all rights, consents, and authorizations necessary to submit Client Data to Funnel Amp, and that doing so does not violate any applicable law or third-party agreement.
